Preamble

This Terms of Service and End User Agreement (“Agreement”) constitutes a legally binding contract between us (“Company,” “we,” “our,” or “us”) and you (“User,” “you,” or “your”). This Agreement governs your access to and use of the MixFind platform (the “Portal”), which is engineered to facilitate transaction reconciliation and statement inquiries.

By accessing, authenticating, or submitting data through the Portal, you acknowledge that you have read, understood, and agree to be bound by the stipulations set forth in this Agreement.

1.0 Scope of Service

1.1 Service Description: The Portal serves as a dedicated billing inquiry tool. It allows individuals to securely identify, verify, and inquire about specific statement descriptors, debits, or credit card charges executed by our authorized billing partners. 

1.2 Limitation of Authority: You acknowledge that the Portal is an informational resource and customer support interface. We are not a bank, credit union, or financial institution. We do not process payments through this Portal, nor do we possess the authority to unilaterally alter official bank statements, force chargebacks, or bypass your issuing bank’s internal policies.

2.0 User Authorization and Access

2.1 Financial Authorization: Access to the Portal is strictly limited to authorized individuals. By initiating an inquiry, you warrant and represent that you are the primary account holder, the primary cardholder, or a legally authorized representative of the individual whose financial information is being queried.

 2.2 Age Requirements: You must be at least 18 years of age, or the age of legal majority in your governing jurisdiction, to utilize this Portal. 

2.3 Prohibited Activities: You are strictly prohibited from utilizing the Portal for fraudulent inquiries, reconnaissance of unauthorized financial data, identity theft, or any activity that violates local, national, or international financial regulations.

3.0 Data Integrity and Information Governance

3.1 Accuracy of User Submissions: To successfully locate and verify a transaction, you must provide precise and accurate transactional data (e.g., exact settlement dates, transaction amounts, and truncated card numbers). The Company bears no responsibility for failed inquiries resulting from inaccurate data submission. 

3.2 Data Protection and Privacy: We recognize the sensitive nature of financial inquiries. Any Personally Identifiable Information (PII) or partial financial data submitted through the Portal is handled in strict accordance with our Privacy Policy. We implement commercially reasonable, industry-standard cryptographic and security protocols to protect data in transit and at rest.

4.0 Intellectual Property Rights

4.1 Proprietary Assets: All systems, algorithms, source code, user interfaces, branding, and proprietary documentation associated with the Portal are the exclusive property of the Company and are protected by applicable intellectual property and copyright laws. 

4.2 Restricted License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access the Portal solely for personal, non-commercial transaction inquiry purposes.

5.0 Disclaimers of Warranties and Fiduciary Duty

5.1 As-Is Provision: The Portal and all associated data are provided on an “as-is” and “as-available” basis. The Company explicitly disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. 

5.2 No Fiduciary Relationship: The provision of this Portal does not establish a fiduciary, advisory, or agency relationship between you and the Company.

6.0 Limitation of Liability and Indemnification

6.1 Liability Cap: To the maximum extent permitted by applicable law, under no circumstances shall the Company, its directors, officers, affiliates, or agents be liable for any indirect, incidental, consequential, special, or exemplary damages, including but not limited to financial losses, data compromise, or reputational harm arising from your use or inability to use the Portal. 

6.2 User Indemnity: You agree to indemnify, defend, and hold harmless the Company against any and all claims, regulatory fines, liabilities, damages, or legal fees arising directly or indirectly from your breach of this Agreement or your fraudulent use of the Portal.

7.0 Modifications and Amendments

We reserve the right to amend, update, or revise this Agreement at our sole discretion to reflect changes in regulatory requirements or operational protocols. Notice of significant amendments will be indicated by an updated “Effective Date.” Continued utilization of the Portal following such modifications constitutes binding acceptance of the revised Agreement.
